Terms of Service

Last updated: May 4, 2026

Part I: Foundations

1. Agreement to Terms

My Jobs Search, LLC is a Michigan limited liability company ("My Jobs Search," "Company," "we," "us," or "our"). The products, features, tools, content, and functionality we make available at myjobssearch.com are referred to collectively in these Terms as the "Services."

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and My Jobs Search, LLC.

You must be at least 18 years of age to use the Services. By using My Jobs Search, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement.

If you are accessing or using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and references to "you" shall include both you individually and the organization.

If you do not agree with any part of these Terms, you must immediately discontinue all use of the Services.

2. My Jobs Search, LLC. Services

My Jobs Search is an AI-powered job search and resume optimization platform designed to help individuals improve their job application materials and streamline their job search process. Our Services include, but are not limited to, the following features:

  • Self-scoring resume analysis engine
  • AI-powered resume optimization and rewriting
  • Cover letter generation
  • Job discovery and matching
  • Achievement library management
  • Application tracking and pipeline management

My Jobs Search is NOT an employment agency, staffing firm, recruiter, or career placement service. We provide tools to assist you in your job search but do not act as an intermediary between you and potential employers.

We do not guarantee any employment outcomes, including but not limited to interviews, job offers, or salary levels. The effectiveness of the Services depends on many factors outside our control, including the job market, your qualifications, and employer hiring practices.

The Services are general-purpose career tools and are not designed, configured, or audited for use in industries or roles that are subject to specialized data-protection or compliance regimes, including without limitation the Health Insurance Portability and Accountability Act (HIPAA), the Federal Information Security Management Act (FISMA), the Gramm-Leach-Bliley Act (GLBA), the Family Educational Rights and Privacy Act (FERPA), the Payment Card Industry Data Security Standard (PCI DSS), or any analogous federal, state, or international framework. If your activities or any content you submit to the Services would be governed by any such law or framework, you must not use the Services. You are solely responsible for ensuring that your use of the Services complies with all laws and regulations applicable to you, your profession, or your employer.

3. User Representations

By using My Jobs Search, you represent and warrant each of the following:

  • You are accessing the Services as a human, not via a bot, script, headless browser, scraping framework, or other automated agent.
  • You are not registering after a previous suspension, termination, or ban from My Jobs Search under any other name or identity.
  • The information you submit during registration and account use is correct as of the time you submit it, and you will keep it current.
  • You are eighteen years of age or older.
  • You are a resident of the United States and are physically located in the United States, and you are not using a VPN, proxy, or other means to disguise your location, as described in Section 25 (Governing Law and Geographic Scope).
  • You have the legal capacity to be bound by these Terms (and, if you are using the Services on behalf of an organization, the authority to bind that organization).
  • Your access to and use of the Services do not violate any federal, state, local, or international law applicable to you.

Part II: Your Account

4. User Registration

To access most features of My Jobs Search, you must create an account through our authentication provider. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated.

You are limited to one account per person. Creating multiple accounts to circumvent plan limits, abuse free tiers, or for any other purpose is strictly prohibited and may result in termination of all associated accounts.

You are solely responsible for maintaining the confidentiality of your account credentials, including your password, and for all activity that occurs under your account. You agree to notify us immediately at support@myjobssearch.com if you become aware of any unauthorized access to or use of your account.

My Jobs Search will not be liable for any loss or damage arising from your failure to maintain the security of your account credentials.

5. Responsible Use

This section addresses the good-faith conduct expected of every account holder. Technical abuse is addressed in Section 11; commercial use is addressed in Section 12.

Account integrity

  • You will not impersonate another person, organization, or My Jobs Search employee, including by using another individual's name, photograph, or work history without permission.
  • You will not share your account credentials with anyone else, allow more than one individual to use a single account, or maintain a session that other people use on your behalf.
  • You will not register additional accounts to evade plan limits, free-tier caps, prior bans, or other restrictions imposed by us.
  • You will not sell, rent, license, sublicense, or otherwise transfer your account, your access to the Services, or any benefit of your subscription to any third party.

Truthful application materials

You are solely responsible for the truthfulness, accuracy, and completeness of all content associated with your account, whether written by you or generated with AI assistance. In particular, you will not submit resumes, cover letters, or other application materials that contain fabricated qualifications, false employment history, misleading credentials, exaggerated accomplishments, or any statement you do not in good faith believe to be accurate.

Misrepresentation on job application materials may violate state or federal law (including consumer protection, fraud, and computer-fraud statutes) and may give an employer grounds to rescind an offer or terminate employment. Use of My Jobs Search does not insulate you from those consequences.

We may suspend or terminate any account we reasonably believe has engaged in conduct prohibited by this Section 5, in addition to any other remedy available under these Terms.

Part III: Billing & Plans

6. Subscription Plans

My Jobs Search offers the following subscription tiers:

  • Free Tier: $0/month with limited feature access.
  • Pro: $24/month with expanded features and usage limits.
  • Premium: $39/month with full access to all features and highest usage limits.

Feature availability, usage limits, and capabilities vary by plan. Specific details of what is included in each plan are described on our pricing page and may be updated from time to time.

We reserve the right to modify, add, or remove features from any subscription plan with reasonable notice. Material changes to your current plan will be communicated via email or in-app notification prior to taking effect.

7. Free Tier

My Jobs Search offers a free tier that provides limited access to the platform's features. The free tier is always available and does not require a credit card to sign up.

The free tier is subject to usage limits and restricted feature access as described on our pricing page. These limits are designed to allow you to evaluate the Services before committing to a paid plan.

We reserve the right to modify, reduce, or discontinue the free tier at any time with reasonable notice. If the free tier is discontinued, existing free-tier users will be notified and given the opportunity to upgrade to a paid plan or export their data.

8. Purchases and Payment

All payments for My Jobs Search subscription plans are processed securely through Stripe. We accept the following payment methods:

  • Visa
  • Mastercard
  • American Express
  • Discover

You agree to provide current, complete, and accurate billing and payment information. You authorize us to charge your selected payment method for all fees incurred under your account.

Paid subscriptions are billed on a recurring basis (monthly or annually, depending on the plan you select) and will continue to renew automatically until cancelled by you. You are responsible for all charges incurred until cancellation takes effect.

We reserve the right to change subscription prices at any time. Price changes will take effect with at least 30 days' prior notice. Your continued use of the Services after a price change constitutes acceptance of the new pricing.

If you believe there is a billing error, you must contact us at support@myjobssearch.com within 30 days of the charge. We will investigate and correct any confirmed errors.

9. Cancellation

How to cancel. You may cancel your paid subscription at any time from your account settings, which opens our billing portal. Cancellation is entirely self-service, takes effect immediately upon submission, and does not require you to contact support, speak with a representative, or provide a reason. We will not require you to complete any additional step that is not required to sign up.

When cancellation takes effect. Cancelling turns off automatic renewal. Your subscription remains active, and you keep full access to your paid plan features, through the end of the billing period you have already paid for. At the end of that period, your subscription ends and your account is downgraded to the free tier. We do not end paid access early, and we do not issue partial or prorated refunds for the unused remainder of a billing period.

Your renewal date and the recommended cancellation window. Paid plans renew automatically on the same calendar day each month, using the payment method on file. Your exact next renewal date is shown in your account settings and in the billing portal, and we recommend checking it there rather than estimating it. To be certain you are not charged for another month, we recommend cancelling at least 24 hours before your renewal date. This is a recommendation, not a requirement: a cancellation submitted at any time before the renewal charge is processed will stop that renewal. The 24-hour buffer exists because renewal is processed by our payment processor on its own schedule and in its own time zone, and because bank, card-network, and processor timing is outside our control.

If your renewal has already been charged. If a renewal charge has already been processed at the time you cancel, that charge stands and is not refundable, and your cancellation applies to the following billing cycle. You will keep full paid access for the entire cycle you were charged for. This is not a penalty and no additional amount is owed; you have simply purchased one more period of the Services. If you believe a renewal was charged in error, or you cancelled and were charged anyway, contact us at support@myjobssearch.com within 30 days of the charge and we will investigate under Section 10 (Refund Policy).

Failed payments. If a renewal payment fails, we may retry the charge over a limited period and will notify you by email. If payment is not completed, your subscription may be suspended or cancelled and your account downgraded to the free tier. Suspension for non-payment does not relieve you of amounts already owed for periods of paid access you received.

Downgrades between paid plans. If you move from a higher-priced plan to a lower-priced plan rather than cancelling entirely, the change takes effect at the start of your next billing period unless we tell you otherwise at the time of the change. You retain your current plan's features until then, and no refund or credit is issued for the difference in price for the current period.

Your data after cancellation. After your paid subscription ends, your data, including resumes, achievements, and application history, is retained for 30 days. During that 30-day window you may reactivate by resubscribing to a paid plan and your data will be restored. After 30 days, your data is permanently deleted and cannot be recovered. You may export your data at any time before then.

Cancellation by us. We may cancel or suspend your subscription as described in Section 27 (Term and Termination). If we cancel your paid subscription for convenience rather than for your breach of these Terms, we will refund the unused prorated portion of the then-current billing period.

Nothing in this section limits any cancellation or refund right you have under the mandatory consumer-protection law of your state or country of residence, including any applicable automatic-renewal statute. Where such a law grants you a greater right than this section provides, that law controls.

10. Refund Policy

My Jobs Search does not provide refunds for partial billing periods. When you cancel your subscription, you will continue to have access to your paid features until the end of your current billing cycle, but no prorated refund will be issued.

If a billing error occurs (such as a duplicate charge or incorrect amount), we will investigate and correct the error within 30 days of it being reported. To report a billing error, contact us at support@myjobssearch.com with the relevant transaction details.

Refunds for confirmed billing errors will be processed through your original payment method and may take 5-10 business days to appear on your statement.

Part IV: Acceptable Use

11. Prohibited Technical Use

This section addresses technical abuse of the Services. The conduct below is prohibited and constitutes a material breach of these Terms. Conduct relating to good-faith account use is addressed in Section 5 (Responsible Use), and conduct relating to commercial use of the Services is addressed in Section 12 (Commercial Misuse).

Automation and scraping

  • Operating bots, scripts, headless browsers, scrapers, or other automated agents against the Services.
  • Harvesting, mirroring, indexing, or aggregating data from the Services through automated or manual means.
  • Imposing an unreasonable load on the Services or its infrastructure (denial-of-service attempts, runaway request loops, intentionally heavy queries, etc.).

Security and reverse engineering

  • Reverse engineering, decompiling, disassembling, or otherwise attempting to derive source code, scoring logic, or model prompts used by the Services.
  • Probing, circumventing, or attempting to disable security controls, paywalls, rate limits, or usage quotas.
  • Uploading or transmitting viruses, malware, ransomware, or any code intended to disrupt the Services or harm any user.

Targeting other users

  • Collecting, harvesting, or attempting to identify personal information about other My Jobs Search users.
  • Harassing, abusing, threatening, or targeting other users through any feature of the Services.

You also agree not to use the Services in any way that violates federal, state, local, or international law applicable to you. We reserve the right to terminate accounts engaged in any of the conduct described above and to pursue any other remedies available under these Terms or at law.

12. Commercial Misuse

My Jobs Search is licensed to you for one purpose only: your own personal job search. The Services are not licensed for any business that prepares, optimizes, or evaluates application materials on behalf of other people, and it is not licensed for use as raw material in any competing product. The following uses are prohibited regardless of subscription tier.

No use on behalf of third parties

  • Operating a resume-writing service, ghost-writing practice, or career-coaching business that uses the Services to produce, edit, or optimize materials for clients.
  • Operating a recruiting, staffing, or outplacement business that uses the Services to evaluate, score, or rewrite candidate materials.
  • Allowing any individual other than the registered account holder to upload their resume, generate AI Content, or otherwise interact with the Services through your account.
  • Aggregating, reselling, or republishing outputs the Services produces for you (Bullseye tiers, keyword analyses, AI-written copy, etc.) as part of any product or service offered to others.

No competing-product development

  • Using the Services, its outputs, or its observable behavior to design, build, train, evaluate, benchmark, or improve any competing resume-scoring, resume-writing, ATS, or AI-career product.
  • Using outputs from the Services as training data, evaluation data, or prompt material for any third-party AI model, regardless of whether that model is publicly distributed.
  • Publishing reviews or comparisons that misrepresent the Services's behavior in order to advantage a competing product (legitimate consumer reviews of your own use are not restricted by this clause).

Use of the Services in violation of this Section 12 is a material breach of these Terms. We may terminate offending accounts immediately, demand return or destruction of derived materials, and pursue any other remedy available under these Terms or applicable law.

13. Services Management

We reserve the right, but not the obligation, to take the following actions to manage and protect the Services:

  • Monitor the Services for violations of these Terms.
  • Restrict, limit, suspend, or disable access to accounts that violate these Terms or applicable laws.
  • Remove or disable content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.
  • Report suspected illegal activity to appropriate law enforcement authorities.
  • Manage the Services in a manner designed to protect our rights, property, and the interests of our users.
  • Enforce rate limits, usage quotas, and other technical restrictions as needed to maintain service quality.

Part V: Content, IP & AI

14. Intellectual Property Rights

All intellectual property rights in the My Jobs Search platform, including but not limited to the software, design, user interface, algorithms, scoring methodologies, code, graphics, branding, and documentation, are owned exclusively by My Jobs Search and are protected by applicable intellectual property laws.

The "My Jobs Search" name, logo, and all related marks are trademarks of My Jobs Search. You may not use, reproduce, or display these trademarks without our prior written consent.

You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, disassemble, or create derivative works based on any part of the Services or its underlying technology. Unauthorized use of our intellectual property may result in termination of your account and legal action.

15. AI-Generated Content

My Jobs Search uses artificial intelligence to generate optimized resumes, cover letters, Bullseye tiers, keyword suggestions, and other outputs ("AI Content"). By using the AI features of the Services, you acknowledge and agree to the following:

  • AI systems can produce errors, inaccuracies, hallucinations, or content that does not reflect your real experience or qualifications.
  • Bullseye tiers, keyword analyses, and optimization recommendations are estimates derived from algorithmic analysis. They do not represent, predict, or guarantee how any specific employer, recruiter, or applicant tracking system will evaluate your application.
  • AI Content is a starting draft. You are responsible for reviewing, verifying, and editing it before submitting any version to an employer.
  • You are solely responsible for the truthfulness, accuracy, and lawfulness of anything you ultimately submit to employers, whether AI-generated, edited, or written from scratch.
  • We do not guarantee the quality, accuracy, effectiveness, or suitability of AI Content for any specific job, role, or context.

AI vendor confidentiality: what you should know before sending us sensitive material

Generating AI Content requires us to send your inputs (including resume text, job-description text, achievements, and related context) to one or more third-party AI providers (such as OpenAI and similar large language model vendors). We do not control how those vendors handle your data internally. Although we contract with vendors that publicly state they do not train their public models on customer API inputs, we cannot guarantee, on the vendors' behalf, that:

  • your inputs will remain confidential at the vendor level;
  • the vendor will not log, cache, retain, or use your inputs for safety, abuse-monitoring, evaluation, or other internal purposes;
  • your inputs will not become accessible to the vendor's employees, sub-processors, contractors, government requests, legal process, or other third parties under the vendor's own policies;
  • portions of your inputs will not surface through future vendor features such as search, retrieval, indexing, or evaluation tooling that the vendor may build on top of historical data; or
  • a vendor's policies, security posture, or staff will remain unchanged over time.

For these reasons, you should not submit anything through My Jobs Search that you would not be comfortable having processed by an outside AI vendor under that vendor's terms. Examples to avoid include trade secrets, your current employer's confidential or proprietary information, NDA-protected material, classified or export-controlled information, regulated personal data of others (HIPAA, GLBA, FERPA, COPPA), or any material you would not want recorded in a vendor log.

By using the AI features of the Services, you accept this risk and waive any claim against My Jobs Search arising from a third-party AI vendor's handling of your inputs that is consistent with that vendor's then-current published policies.

16. User-Generated Content

You retain full ownership of all content you create, upload, or provide to My Jobs Search, including your resumes, cover letters, achievements, work history, and other personal materials ("User Content"). We do not claim any ownership interest in your User Content.

By using the Services, you grant My Jobs Search a limited, non-exclusive, non-transferable license to process, display, store, and transmit your User Content solely for the purpose of delivering the Services to you. This license terminates when you delete your content or your account is closed.

We may use anonymized, aggregated data derived from User Content for analytics, research, and service improvement purposes. Such aggregated data will not identify you personally and cannot be used to reconstruct your individual content.

17. Contribution License

If you provide any feedback, suggestions, feature requests, ideas, bug reports, or other contributions regarding My Jobs Search ("Contributions"), you agree that such Contributions become the sole property of My Jobs Search upon submission.

We may use, modify, incorporate, distribute, and commercialize any Contributions without restriction, compensation, attribution, or obligation to you. You waive any moral rights or claims you may have in such Contributions.

This section does not apply to your User Content (such as resumes and achievements), which remains governed by Section 16.

Part VI: Privacy & Data Handling

18. Privacy Policy

Your use of My Jobs Search is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information. The Privacy Policy is incorporated into these Terms by reference.

By creating an account and using My Jobs Search, you consent to the data collection and processing practices described in our Privacy Policy. We encourage you to review the Privacy Policy carefully before using the Services.

If there is a conflict between these Terms and the Privacy Policy, the Privacy Policy shall govern with respect to data privacy and protection matters.

19. User Data

You are solely responsible for maintaining backups of any data you provide to or create within My Jobs Search. While we take reasonable measures to protect your data, we are not liable for any loss, corruption, or destruction of your data, whether caused by system failures, security incidents, or other circumstances.

Following account deletion or termination, your data will be retained for a period of 30 days. After this retention period, all data associated with your account will be permanently and irreversibly deleted from our systems.

You may export your data at any time through your account settings or by contacting support@myjobssearch.com. We recommend periodically exporting your important data as a precautionary measure.

20. Third-Party Services

My Jobs Search integrates with and relies on various third-party services to deliver its functionality, including:

  • Authentication providers: for secure user login and account management.
  • Job Board Provider: for job discovery and listing data. My Jobs Search integrates with third-party job boards for job discovery. All trademarks belong to their respective owners.
  • AI service providers: for content generation, analysis, and optimization.
  • Payment processors (Stripe): for secure billing and subscription management.
  • Cloud hosting providers: for infrastructure, storage, and service delivery.

We are not responsible for the availability, accuracy, performance, or policies of any third-party service. Third-party services are governed by their own terms of service and privacy policies. Your use of My Jobs Search constitutes acknowledgment that third-party service disruptions may temporarily affect the availability or functionality of our Services.

21. Electronic Communications

By creating a My Jobs Search account, you consent to receive electronic communications from us, including but not limited to email messages and in-app notifications. These communications may include service announcements, account notifications, billing confirmations, security alerts, and promotional materials.

You agree that electronic communications from My Jobs Search satisfy any legal requirement that such communications be made in writing. Electronic records of communications shall be considered valid and enforceable to the same extent as paper-based communications.

You may opt out of marketing and promotional emails at any time by using the unsubscribe link included in such emails or by adjusting your notification preferences in your account settings. However, you may not opt out of transactional or service-related communications (such as billing confirmations, security alerts, and Terms updates), as these are essential to your use of the Services.

Part VII: Legal Protections

22. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS, AND WITHOUT WARRANTIES OF ANY KIND. To the fullest extent permitted by applicable law, My Jobs Search and its officers, directors, employees, agents, and licensors disclaim all warranties, whether express, implied, statutory, or arising from course of dealing or usage of trade, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, system integration, and non-infringement.

Without limiting the above, we do not warrant or represent that:

  • AI-generated content will be accurate, current, complete, or appropriate for any specific application or hiring context.
  • Bullseye tiers, keyword analyses, or optimization suggestions correspond to how any specific employer, recruiter, or applicant tracking system will evaluate your application.
  • Use of the Services will produce any particular employment outcome, including interviews, callbacks, offers, response rates, or salary improvements.
  • Job listings discovered through the Services are still open, accurately described by the source job board, or otherwise reliable.
  • The Services will be uninterrupted, error-free, secure against compromise, or available at any specific level of uptime.
  • The Services will meet your specific requirements, expectations, workflow, or use case.

23. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO CASE SHALL MY JOBS SEARCH OR ITS PERSONNEL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF MY JOBS SEARCH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

This exclusion applies to, but is not limited to, damages arising from:

  • any handling, retention, logging, or disclosure of your inputs by third-party AI vendors, hosting providers, or other sub-processors;
  • your reliance on AI-generated content, Bullseye tiers, keyword recommendations, or any other algorithmic output;
  • adverse employment outcomes, missed interviews, lost callbacks, or rejected applications;
  • loss or corruption of resumes, achievements, application history, or other data you store with the Services;
  • lost revenue, lost profits, lost business opportunities, or lost goodwill;
  • personal injury, property damage, or emotional distress arising from your use of the Services.

Notwithstanding any other provision of these Terms, the total aggregate liability of My Jobs Search and its personnel for all claims relating to these Terms or the Services is capped at the greater of (a) the amounts you actually paid to My Jobs Search in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100.00).

24. Indemnification

You agree to indemnify, defend, and hold harmless My Jobs Search, its officers, directors, employees, agents, affiliates, and licensors from and against any claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and expert costs) arising out of or relating to:

  • any misrepresentation, fabrication, or false credential you include in resumes, cover letters, applications, achievements, or other content you submit through the Services or to any employer;
  • any content you upload, generate, store, or transmit using the Services (including AI prompts, achievements, employment history, and any personal information of yourself or others);
  • a third party's claim that your content infringes its copyright, trademark, trade secret, publicity, privacy, or other rights;
  • your unauthorized use of the Services, including any conduct prohibited by Sections 5 (Responsible Use), 11 (Prohibited Technical Use), or 12 (Commercial Misuse);
  • your breach of any representation, warranty, or other obligation in these Terms or in any policy referenced in these Terms;
  • your access to or use of the Services generally, including liability arising from a third-party AI vendor's processing of inputs you submitted through the Services.

Where any third-party claim falls within the scope of your indemnification obligations under this Section 24, My Jobs Search may, at our discretion and at your cost, take over the handling, defense, and resolution of that claim. If we exercise this option, you must promptly hand off control to counsel of our choosing, supply documents, records, and witness availability that we reasonably request, and refrain from making admissions, settlement offers, public statements, or other binding representations about the claim without our prior written approval.

This indemnification obligation shall survive termination of your account and these Terms.

25. Governing Law and Geographic Scope

These Terms of Service and any disputes arising out of or related to them or the Services shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to its conflict of law principles or provisions.

You consent to the personal jurisdiction of the state and federal courts located in the State of Michigan and agree that such courts shall be the exclusive venue for any legal proceeding arising out of or relating to these Terms or the Services.

United States Only. The Services are offered, operated, and directed solely to users located in the United States. They are hosted in the United States, priced in United States dollars, and designed around United States hiring practices, resume conventions, and employment norms. We make no representation that the Services are appropriate, lawful, or available for use in any other country. We do not market, offer, or make the Services available to individuals in the European Economic Area, the United Kingdom, Switzerland, or any other jurisdiction outside the United States, and we do not intend to target or monitor individuals in those jurisdictions.

Eligibility. To register for or use the Services, you must be physically located in the United States and must be a United States resident. If you are located outside the United States, you are not authorized to access or use the Services, and you must not create an account or submit any personal information to us. This limitation is based solely on where the Services are operated and lawfully offered. It is not based on nationality, citizenship, ethnicity, national origin, religion, or any other protected characteristic, and it applies equally to everyone located outside the United States.

No Circumvention of Location Controls. You may not use a virtual private network (VPN), proxy server, anonymizing relay, remote desktop, falsified billing or address information, or any other method to disguise your location or to access the Services from outside the United States. Doing so is a material breach of these Terms. We may use IP geolocation, billing address, payment method country, and similar signals to determine eligibility, and we may suspend or terminate any account we reasonably believe is being accessed from outside the United States or is circumventing these controls. Where we terminate an account on this basis and the account is in good standing in all other respects, we will refund the unused prorated portion of the then-current billing period.

Local Law. If you access the Services from outside the United States in breach of this section, you do so on your own initiative and at your own risk, and you are solely responsible for compliance with the laws of the jurisdiction in which you are located. Accessing the Services in breach of this section does not create any obligation on our part under the law of that jurisdiction, and does not constitute an offering of the Services in, or a targeting of individuals in, that jurisdiction.

26. Dispute Resolution

Informal Resolution First. Before initiating any legal proceeding, you agree to first attempt to resolve any dispute, claim, or controversy informally by contacting us at legal@myjobssearch.com with a written description of the dispute and the relief you are seeking. You agree to allow at least 30 days for informal resolution before pursuing any other remedy. Most disputes are resolved at this stage, and we ask that you use it.

WAIVER OF JURY TRIAL. EACH PARTY WAIVES, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY RIGHT IT MAY HAVE TO A TRIAL BY JURY IN ANY SUIT OR PROCEEDING ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICES.

Venue. Any action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in the State of Michigan, as set out in Section 25 (Governing Law and Geographic Scope).

Urgent Relief. Either party may seek injunctive, declaratory, or other equitable relief from a court of competent jurisdiction without first completing the 30-day informal resolution period, where the claim concerns actual or threatened infringement, misappropriation, or unauthorized disclosure of intellectual property rights; actual or threatened unauthorized access, scraping, automated harvesting, or reverse engineering of the Services; or any other claim where monetary damages alone would not provide an adequate remedy.

Time Limit on Claims. Any claim, dispute, or cause of action arising out of or related to these Terms or the Services must be filed within one (1) year after the cause of action arose, regardless of any longer period otherwise allowed by statute. Claims not brought within this one-year window are permanently barred, to the fullest extent permitted by applicable law.

Part VIII: Lifecycle & Changes

27. Term and Termination

These Terms remain in full force and effect for as long as you maintain an account with or continue to use My Jobs Search. We reserve the right to terminate or suspend your account immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

Upon termination of your account, your right to access and use the Services ceases immediately. Your data will be retained for 30 days following termination, after which it will be permanently deleted. During the 30-day retention period, you may contact us to request an export of your data.

The following provisions shall survive termination of these Terms: Intellectual Property Rights (Section 14), Disclaimer of Warranties (Section 22), Limitation of Liability (Section 23), Indemnification (Section 24), Governing Law (Section 25), Dispute Resolution (Section 26), and any other provisions that by their nature should survive termination.

You may terminate your account at any time by cancelling your subscription (if applicable) and deleting your account through your account settings, or by contacting us at support@myjobssearch.com.

28. Modifications and Interruptions

We reserve the right to modify, update, redesign, or discontinue any aspect of the Services at any time and without prior notice. This includes changes to features, functionality, user interface, algorithms, and available integrations.

We are not liable for any downtime, service interruptions, maintenance windows, or outages, whether planned or unplanned. We do not guarantee that the Services will be continuously available, error-free, or uninterrupted.

While we strive to maintain consistent uptime, factors beyond our control, including third-party service outages, network failures, and force majeure events, may result in temporary unavailability. We will make reasonable efforts to notify users of planned maintenance in advance when possible.

29. Changes to Terms
